Illinois RTA ADA Paratransit Fund for PACE: UPDATE HB585: Passed Both Houses 5/19/2011

Below is the Synopsis of 97th General Assembly HB585, which Amends the Regional Transportation Authority Act for Partransit Funding. The bottom line is that the projected yearly budget will be put into a separate fund for Pace to provide Paratransit Service before CTA, Metra, Pace fixed route operating budget is distributed.

Synopsis As Introduced
Amends the Metropolitan Pier and Exposition Authority Act. Makes a technical change in a Section concerning purchases.

Replaces everything after the enacting clause. Amends the Regional Transportation Authority Act. Provides that any funds deposited in accordance with the Act that are necessary to fully fund ADA paratransit services shall be deposited into the ADA Paratransit Fund. Further provides that in 2012 and each year thereafter, the Authority shall deposit no less than 105% of the actual funding expended on ADA paratransit services in the prior year. Sets forth requirements concerning the projected annual costs of providing ADA paratransit services. Provides that in the case of insufficient funds for the current calendar year, the Authority shall deposit from its discretionary funds an amount equal to the projected shortfall into the ADA Paratransit Fund. Effective immediately.

Replaces everything after the enacting clause. Amends the Regional Transportation Authority Act. Adds that the Regional Transportation Authority shall deposit into the ADA Paratransit Fund any additional funds necessary to fund the budget or amended budget for ADA paratransit services adopted or approved by the Board of the Regional Transportation Authority for the current year. Provides that the Board of the Regional Transportation Authority shall consider the written determination of the Executive Director of the Regional Transportation Authority concerning the costs of ADA paratransit services that are required to be provided under the federal Americans with Disabilities Act of 1990 and its implementing regulations, and shall amend the current year budgets of the Authority and the Service Boards to provide for additional funding for the provision of ADA paratransit services, if needed. Effective immediately.

House Floor Amendment No. 5
With respect to the changes in the bill concerning the ADA Paratransit Fund, provides that annual deposits into the Fund by the Regional Transportation Authority shall include in 2013 and thereafter an amount equal to (instead of 105% of) the final budgeted funding for ADA paratransit services for the current (instead of prior) year.
